Promotion and Execution Assistance of Environmental Protection Agreement for Year 2010

This Project included three major parts: (1) analysis of the nature of domestic public nuisance disputes and the existing Environmental Dispute Resolution Act (the Act), and examination of the implementation of environmental protection agreements, (2) a comparative analysis of the legislations of environmental protection agreements (or so-called “public nuisance prevention agreement in Japan”/“voluntary environmental agreements in the U.S.”) in Japan and US;and (3) to assist the execution of environmental protection agreements, to be consulted on the legal matters regarding public nuisance disputes and to promote the proper legal approaches for resolution of public nuisance disputes. This Project has completed the legal analysis of environmental protection agreements and explores the benefit and plausibility of environmental protection agreements in Taiwan. Also, this Project introduces the environmental protection agreements systems adopted in Japan and US, with a focus on the practical implementation, the development trend, and the legislation rationales at those countries. In addition, this Project also explored the possibilities of adopting the systems used in such foreign jurisdictions, and the pros and cons thereof. At the same time, this Project has held 5 seminars to promote the environmental protection agreements and conducted a work development report. The Project also conducted several endeavors on promotion of environmental protection agreements and assisting the execution thereof.
